The ED requested a 14-day extension of his judicial custody, citing the pending application which was not addressed earlier due to Kejriwal’s interim bail for Lok Sabha campaigning. Judge Sanjeev Aggarwal of the Rouse Avenue Court decided to extend his custody until June 5.

The ED argued for Kejriwal’s judicial custody, stating, “Arvind Kejriwal has been made an accused, and since the cognisance is pending, we are praying for judicial custody of him,” as quoted by ANI. However, Kejriwal’s advocates, Rishikesh Kumar and Vivek Jain, opposed the application, highlighting that Kejriwal’s arrest in the excise policy case has been challenged in the Supreme Court, with an order on his petition reserved.

On Saturday, the court reserved its decision on Kejriwal’s fresh interim bail plea for seven days on medical grounds related to the Excise Policy money laundering case. Kejriwal’s regular bail plea is scheduled for hearing on June 7, 2024.

AAP Chief National Spokesperson Priyanka Kakkar criticized Kejriwal’s imprisonment, stating, “The investigation in this alleged liquor scam has been going on for the last two years, and there has not been a single penny of recovery from any of our leaders. They have put Arvind Kejriwal in jail without any recovery or evidence, and the people are taking note of it,” as reported by PTI.

The Supreme Court granted Kejriwal interim bail on May 10 in the money laundering case linked to the Delhi excise policy. The order, effective until June 1, barred Kejriwal from visiting the Office of the Chief Minister and the Delhi Secretariat, and required him to surrender on June 2.

The AAP and Kejriwal deny all charges, accusing the BJP of “political vendetta” ahead of the elections. They allege that federal agencies like the ED target opposition leaders under instructions from Prime Minister Narendra Modi’s government, a claim denied by the centre.

Kavitha denies the charges and questions the timing of the ED and CBI actions, which occurred shortly before the general elections. The ED has also arrested other AAP leaders in the case, including former Delhi Deputy Chief Minister Manish Sisodia and Rajya Sabha MP Sanjay Singh.

The initial outcome had seen the BJP winning on January 30, with Manoj Sonkar defeating Kuldeep Kumar after securing 16 votes against his rival’s 12. However, Sonkar subsequently resigned, and three AAP councillors defected to the BJP.

The controversy revolved around the 8 ballots declared invalid by the Presiding Officer. Out of a total of 36 votes, only 28 were counted, with the AAP councillor receiving 12 votes and the BJP candidate securing 16 votes.

1. Deliberate Defacement: The court ruled that the presiding officer made a deliberate attempt to deface the 8 ballot papers.
2. Prosecution Initiation: The bench, consisting of Chief Justice of India DY Chandrachud, Justice JB Pardiwala, and Justice Manoj Misra, ordered the prosecution of returning officer Anil Masih for misdemeanour.
3. Ballot Inspection: Upon physical inspection of the ballots, the court found that the 8 “invalid” ballots actually had votes in favor of the AAP councillor.
4. Legal Proceedings: The court deemed it a fit case for initiating proceedings under Section 340 CrPC against Anil Masih, directing the Registrar Judicial to issue a notice to him to show cause as to why steps should not be initiated against him under Section 340 CrPC.
5. Ink Mark Inconsequence: The Supreme Court noted that the ink mark placed by the Presiding Officer at the end of the eight ballots had no consequence, emphasizing that all eight received the stamp for Kuldeep Kumar.

The ongoing case before the Supreme Court originated from a plea filed in 1985 by environmentalist MC Mehta regarding air pollution.
