<p>In a recent address at a social media warriors&#8217; meet in Hyderabad&#8217;s Secunderabad, Union Home Minister Amit Shah criticized the Congress party for its opposition to the Citizenship (Amendment) Act, or CAA, attributing it to what he described as &#8220;appeasement and vote-bank politics.&#8221; Shah&#8217;s remarks followed the implementation of the CAA by the Centre, marking over four years since its passage in Parliament.</p>



<p>&#8220;We had said we will bring CAA. The Congress party opposed the CAA. Since Independence, it was a promise of the Congress and makers of our Constitution that citizenship would be granted to those persecuted on religious grounds in Bangladesh, Afghanistan, and Pakistan, who come (to India). But, due to appeasement and vote-bank politics, the Congress party opposed the CAA,&#8221; Shah asserted.</p>



<p>The CAA, introduced by the PM Modi-led government, aims to confer Indian nationality to persecuted non-Muslim migrants, including Hindus, Sikhs, Jains, Buddhists, Parsis, and Christians, who migrated from Bangladesh, Pakistan, and Afghanistan and entered India till December 31, 2014, due to &#8220;religious persecution or fear of religious persecution.&#8221;</p>



<p>Shah emphasized Prime Minister Modi&#8217;s intention to honor refugees through the CAA, highlighting the plight of Hindu, Sikh, Buddhist, and Jain communities who fled persecution. He underscored the significance of granting citizenship to these individuals, citing instances where they felt &#8220;insulted&#8221; in their own countries due to the lack of recognition.</p>



<p>The implementation of the CAA drew swift criticism from opposition parties, with the Congress questioning the timing of the move. Congress General Secretary Jairam Ramesh denounced the delay in notifying the rules, labeling it as another instance of the Prime Minister&#8217;s &#8220;blatant lies,&#8221; particularly in light of the upcoming Lok Sabha elections.</p>



<p>In Assam, where protests against the CAA have been particularly fervent, Congress workers led by Debabrata Saikia staged a protest, expressing their discontent with the law. Similar sentiments reverberated across the nation, with several other opposition leaders condemning the CAA&#8217;s implementation.</p>

<p>West Bengal Chief Minister Mamata Banerjee labeled the notified rules as &#8220;unconstitutional and discriminatory,&#8221; urging caution among citizens considering applying for citizenship under the law. She raised concerns over the legal validity of the rules and asserted that the CAA and its associated regulations contravene Article 14 of the Constitution, which guarantees the right to equality.</p>



<p>Meanwhile, Tamil Nadu Chief Minister MK Stalin dismissed the CAA as &#8220;divisive and bereft of any use,&#8221; declaring his intention not to implement it in his state. Stalin emphasized that the law fosters divisions among Indian citizens and called for its repeal.</p>



<p>The CAA&#8217;s introduction in Parliament in December 2019 sparked widespread protests across the country, particularly in Assam and other northeastern states. Critics argue that the law undermines India&#8217;s secular fabric by privileging citizenship based on religious identity. They express concerns over the exclusion of Muslim migrants from neighboring countries facing persecution, thus fueling accusations of discrimination.</p>



<p>In conclusion, the implementation of the Citizenship (Amendment) Act has reignited debates over India&#8217;s commitment to secularism and inclusivity. While proponents argue that the law offers refuge to persecuted minorities, opponents decry it as discriminatory and unconstitutional. The ongoing discourse surrounding the CAA underscores the complex interplay between religion, politics, and citizenship rights in India.</p>

<p>The Lok Sabha, through a voice vote, passed three bills aimed at replacing the colonial-era criminal laws, marking a significant legislative development. Introduced by Home Minister Amit Shah, the redrafted bills are named the Bharatiya Nyaya (Second) Sanhita, Bharatiya Nagarik Suraksha (Second) Sanhita, and the Bharatiya Sakshya (Second) Bill. Alongside these, the Telecommunications Bill, 2023, was also passed through a voice vote.</p>



<p>The proceedings occurred in the absence of 97 Opposition MPs, who were suspended due to misconduct and unruly behavior over the past week. The trio of bills seeks to replace the Indian Penal Code-1860, the Code of Criminal Procedure Act-1898, and the Indian Evidence Act of 1872, respectively.</p>



<p>Amit Shah emphasized that these bills were formulated after thorough consultations, with meticulous scrutiny of every detail before being tabled in the Lok Sabha. The proposed laws aim to establish a justice system grounded in Indian principles, challenging the colonial mindset reflected in existing laws that focus on punishment rather than justice.</p>



<p>Elaborating on the changes introduced by the bills, Shah highlighted the provision for trial in absentia as a notable addition to the criminal justice system. This allows for cases involving individuals hiding in other countries to proceed with trials even if they fail to appear in court within 90 days. Shah asserted that appointing a public prosecutor for their prosecution and ensuring a swift trial would expedite the process and change their legal status in the other country.</p>



<p>Under the proposed laws, the accused will now have seven days to file a plea for acquittal, and the judge must conduct the hearing within that timeframe. The maximum time for a case to come to trial is set at 120 days. Additionally, provisions for plea bargaining have been introduced, where accepting one&#8217;s crime within 30 days of its occurrence will result in a reduced punishment.</p>



<p>Shah emphasized that the new laws address financial challenges for the poor seeking justice, aiming to eliminate delays in the judicial process. By establishing clear parameters, the legislation seeks to bring transparency and efficiency to the legal system. The passage of these bills represents a significant step toward modernizing and reorienting India&#8217;s legal framework.</p>

<p>The Union government has put forth a proposal to broaden the definition of a &#8220;terrorist act&#8221; within the penal law, encompassing threats to the &#8220;economic security&#8221; and &#8220;monetary stability&#8221; of the country. The revised Bharatiya Nyaya (Second) Sanhita Bill, 2023, presented by Union Home Minister Amit Shah in the Lok Sabha, aims to replace the outdated Indian Penal Code (IPC). The proposed changes also introduce new provisions addressing &#8220;cruelty&#8221; against women in marital relationships and penalties for publishing court proceedings that could reveal the identity of a rape victim.</p>



<p>Notably, the government&#8217;s proposal did not incorporate a parliamentary panel&#8217;s suggestion to introduce a gender-neutral provision criminalizing adultery or a separate clause criminalizing non-consensual gay sex. Alongside the Bharatiya Nyaya (Second) Sanhita Bill, Shah introduced two additional updated criminal law bills, namely Bharatiya Sakshya (Second) Sanhita and Bharatiya Nagarik Suraksha (Second) Sanhita, which are intended to replace the Indian Evidence Act and Code of Criminal Procedure (CrPC), respectively. These bills are scheduled for debate on Thursday.</p>



<p>Initially introduced by the government in August, the three criminal law bills underwent review by the parliamentary standing committee on Home Affairs. Shah withdrew the original bills on Monday and reintroduced modified versions that incorporated the panel&#8217;s recommendations. The proposed amendments underscore the government&#8217;s commitment to addressing evolving challenges and strengthening the legal framework to ensure national security and the well-being of its citizens.</p>

<p><strong>Amit Shah</strong> has been on a tour of West Bengal for the past two days, he met BCCI President Sourav Ganguly today. Not only that, Amit Shah also had a meal with Ganguly&#8217;s family.</p>



<p>Amit Shah reached Ganguly&#8217;s residence in Kolkata. From this meeting of both, it is speculated that Sourav Ganguly may join the Bharatiya Janata Party. Last year too, the debate about this gained momentum, but then Ganguly refused to join the BJP.</p>

<p>However, after the meeting with Shah, Ganguly termed it as a courtesy call..He said that he has known Amit Shah for a long time, and he came only for a visit. Suvendu Adhikari who defeated Chief Minister Mamata Banerjee from Nandigram was also present along with Shah.</p>

<p>An important decision has been taken by the central government regarding the North-Eastern states. The long-standing demand of the north-eastern states has finally been accepted by the central government.</p>



<p>Taking a major step towards the northeastern states, the central government has decided to regionalize the Armed Forces Special Powers Act (AFSPA) from Assam, Nagaland and Manipur. This special law will now be limited to certain areas of these states. There has been a long-standing demand for the removal of this law from the North-Eastern states.</p>



<p>However, instead of doing away with it completely, the Center has decided to limit it to some disturbed areas. Union Home Minister Amit Shah has welcomed this decision of the government. He said the decision would usher in a new era of peace and prosperity in the North-Eastern states which have been suffering from decades of neglect.</p>

<p>Not only there have been repeated protests in the north-eastern states on the issue of AFSPA, in some states this issue has also been made a political issue. But now the central government is reducing the AFSPA in the area, there will be relief on many issues at once.</p>
